ARTICLE 9 – Personal Data
9.1. Processing of personal data by CLASSE 7 COMMUNICATION and the Client as data controllers within the framework of order and execution of services
As part of the order and execution of services, the Client and CLASSE 7 COMMUNICATION, as data controllers, are led to process personal data of employees, managers, subcontractors, agents, and/or service providers of the other party (e.g., name, first name, email, phone, etc.).
Each party commits to respecting the confidentiality and security of these personal data in accordance with Law No. 78-17 of January 6, 1978, as well as the GDPR provisions.
Employees, managers, subcontractors, agents, and/or service providers whose data have been collected and processed by the other party have the right to exercise their personal data rights (access, rectification, deletion, objection, restriction, portability, and the right not to be subject to automated individual decisions).
They also have the right to file a complaint with the competent supervisory authority (www.cnil.fr). These personal data are kept for three (3) years from the end of services, except if otherwise required by law.
9.2. Processing of personal data of internet users visiting the Client’s website:
9.2.1 – CLASSE 7 COMMUNICATION, as a subcontractor under the GDPR, is authorized to process personal data collected by the Client through contact and recruitment forms on the Client’s presentation site. The personal data relate notably to internet users and recruitment candidates of the Client and include name, first name, email address, phone number, CV, and cover letter.
The purpose of processing each personal data is to ensure contact and information requests from prospects and allow unsolicited job applications from internet users.
They are kept according to the Client’s privacy policy.
CLASSE 7 COMMUNICATION must keep a written record of all personal data processing it performs on behalf of the Client under Article 30.2 of the GDPR.
9.2.2 – CLASSE 7 COMMUNICATION commits to:
a) process personal data only for the purposes defined by the Client;
b) process personal data according to the Client’s instructions;
c) inform the Client immediately if any new instructions breach applicable personal data laws;
d) transfer personal data outside the EU only with prior written authorization and assurance of adequate protection;
e) ensure personnel with data access are bound to confidentiality;
f) implement data protection by design and default in its tools, products, applications, or services;
g) assist Client with impact assessments, audits, and inspections, providing necessary documentation;
h) notify Client in writing before subcontracting any data processing activities;
i) delete or return data to Client at contract end unless legally obliged to retain;
j) inform Client about CNIL inspections;
k) assist Client during CNIL inspections.
9.2.3 – CLASSE 7 COMMUNICATION may engage another subcontractor to carry out processing activities instructed by the Client. In such cases, its sole obligation is to inform the Client in writing in advance of any planned changes regarding the addition or replacement of other subcontractors.
Each subcontractor is required to comply with the obligations of this article on behalf of and according to the instructions of the Client. CLASSE 7 COMMUNICATION commits to ensuring that each subcontractor it uses provides sufficient guarantees regarding compliance with the applicable personal data protection legislation.
In the event of poor performance of its obligations by the authorized subcontractor, CLASSE 7 COMMUNICATION remains fully liable to the Client for the subcontractor’s compliance with its obligations.
9.2.4 – The Client is responsible for informing the data subjects about the processing of their personal data and their rights. A standard privacy policy is provided by default on the legal notice page of the website, but the Client remains solely responsible for ensuring its compliance with personal data legislation and its specific circumstances.
The data subjects must exercise their rights (right of access, rectification, erasure and objection, right to restriction of processing, right to data portability, right not to be subject to an automated individual decision-making process including profiling) directly with the Client.
9.2.5 – In the event of a personal data breach (e.g., security flaws), CLASSE 7 COMMUNICATION undertakes to inform the Client as soon as possible after becoming aware of it, to allow the Client to notify the CNIL if the latter has not already identified it.
Within the same timeframe, CLASSE 7 COMMUNICATION commits to providing the Client with any relevant details and documentation in its possession to support the Client’s notification to the CNIL as well as informing the data subject. This documentation shall include at least the following information :
- a description of the nature of the personal data breach, including if possible, the categories and approximate number of data subjects affected by the breach and the categories and approximate number of personal data records concerned;
- a description of the likely consequences of the personal data breach;
- a description of the measures taken or proposed to be taken to address the personal data breach, including, where applicable, measures to mitigate its possible adverse effects.
Intellectual Property
The site’s structure, texts, data, graphic elements, animations, videos constitute works protected by intellectual property laws including copyrights, designs, trademarks, and international treaties. They must not be modified, reproduced, displayed, distributed, or used for commercial or public interest purposes without authorization.
Anyone downloading or collecting information from the site only has a private, personal, non-transferable right of use.
Information collected is limited to one paper or digital copy. Source must be cited for any use. Protected works not owned by WEBLEX have been authorized for reproduction by rights holders.
